The Government of Mexico files an Amicus Curiae brief in the lawsuit against Utah House Bill 497

Tuesday, June 7, 2011 | Press Release # 197 | Mexico City

The Ministry of Foreign Affairs informs that the Government of Mexico has filed a Friend of the Court Brief (Amicus Curiae) before the U.S. District Court for the District of Utah, in the lawsuit filed by several US civil society organizations to challenge the constitutionality of Utah’s HB 497 (Utah Coalition of La Raza et al. v. Gary R. Herbert and Mark Shurtleff). As a result of this process, on May 11 the Court issued a stay of the entry into force of this law.

House Bill 497 was signed by Utah’s Governor on March 15. Some of its provisions would criminalize immigration and could lead to the selective application of the law. Its enforcement could adversely affect the civil rights of Mexican nationals residing in Utah or visiting that State.

The Government of Mexico values the participation of the governments of Argentina, Brazil, Chile, Colombia, Costa Rica, Ecuador, El Salvador, Guatemala, Honduras, Nicaragua, Paraguay, Peru and Uruguay, who decided to support this Friend of the Court Brief.

The Mexican Government will continue to make use of all available means and channels in order to firmly and immediately respond to any violation of the fundamental rights of Mexicans, regardless of their migratory status.
